The Court makes preliminary remarks and hears from Plaintiff William Wong as to his 148 Motion to Continue the trial.
For reasons stated on the record, IT IS ORDERED the 144 Order Granting the Stipulation to Amend Pleadings to Substitute Proper Party and Amend Case Caption is VACATED as to Plaintiff William Wong only. The 148 Motion to Continue is DENIED. This case(s) shall proceed to trial on Monday October 5, 2026 at 8:30 a.m.
IT IS FURTHER ORDERED Plaintiff William Wong is given until 5:00 p.m. on Saturday, 10/3/2026, to file a motion in limine as it relates to his intent to raise the issue of misrepresentation at trial.
IT IS FURTHER ORDERED attorney Erick Ferran is excused from attending the trial beginning Monday 10/5/2026.
IT IS FURTHER ORDERED Counsel shall email to the Courtroom administrator a proposed witness schedule by Monday, 10/5/2026 at 7:00 a.m.
IT IS FURTHER ORDERED counsel shall exchange proposed exhibits for each days witnesses the afternoon prior to testimony. (This includes the first witness(es) for Monday 10/5/26). The individual lists shall then be combined into one list, shall include any objections by opposing counsel, and this combined/joint list shall be emailed to the courtroom administrator no later than 7 p.m. nightly.
Plaintiff Judy Wong makes a verbal request to allow the custodian of records to appear remotely. IT IS ORDERED this motion is DENIED.
By 5:00 p.m. Sunday, 10/4/2026, Plaintiff Judy Wong is instructed to notify the Court and opposing counsel of the dollar amount of past medical expenses, as well as the damages figure they intend to seek at trial;
By 5:00 p.m. Saturday 10/4/2026, Plaintiff shall also identify, with a map or diagram, which past incidents from the 145 Motion match the area of the occurrence of slip-and-falls by relation of either area and/or floor type.
By noon on Sunday, any demonstrative exhibits must be shared with opposing counsel. Objections should be emailed to the Court by Sunday at 5:00 p.m. and ready for argument Monday morning. Parties are instructed that last minute filings for consideration of the Court must be made electronically for the sake of expediency and can not be submitted in paper format to the Clerks office.
