ORDER DENYING 48 Motion to Compel, 46 Motion to Preserve Frangible Evidence. The parties have complied with this Court's order (Doc. 50) to respond to the outstanding motions. (See Docs. 53 , 54 , 55 ). As to Defendants' 48 motion to compel: Pro se Plaintiff David K. Ogden avers that he has responded to the outstanding interrogatories and requests for production, and that their motion pre-dated an orally agreed-upon date for his compliance. In light of his pro se status, and in light of his claim to have complied, the Court DENIES Defendants' motion as MOOT. As to Ogden's motion to preserve frangible evidence: Defendants correctly point out that Ogden has provided no evidence to suggest that they will destroy necessary documentation without a preservation order beyond a conclusory statement of his own belief. They further aver they will comply with their preservation obligations. In light of this averment, Ogden's insufficient showing, and the availability of other remedial options in the event evidence is destroyed, the Court DENIES Ogden's motion. The Court believes this should address all outstanding concerns; to the extent there are unresolved issues, however, the Court is prepared to set a status conference if either party so requests. If any party desires a status conference to address unresolved issues arising from these two motions, the party SHALL file a motion requesting such a conference on or before August 3, 2026.
