ORDER STRIKING 42 Amended Complaint. Plaintiff David K. Ogden has filed an amended complaint on the docket (Doc. 42 ). (While the document's caption on the docket is "Second Motion to Amend/Correct 1 Notice of Removal, Plaintiffs Second Amended Complaint," the actual document's title is "Plaintiff's Second Amended Complaint." It is apparent from the document's contents that it is intended only to be an amended complaint, not a motion. It is unclear to the Court why it has been labeled a "second" amended complaint, as it is Ogden's first attempt to amend.) However, because Ogden did not file this amended complaint within the time period permitted by Federal Rule of Civil Procedure 15(a)(1), which addresses amendments for which a party does not need permission, this attempt to amend his complaint is instead governed by Rule 15(a)(2). Under that Rule, Ogden needed to seek and receive leave from this Court before filing an amended complaint. Fed. R. Civ. P. 15(a)(2). Ogden did not seek leave before filing his amended complaint. Nor did he follow the procedures set out in this Court's local rules for doing so. SDIL-LR 15.1. Accordingly, the Clerk of Court is DIRECTED to strike the amended complaint from the docket. (Doc. 42 ). If Ogden wishes to file an amended complaint, he must first file a motion on the docket seeking permission to file the amended complaint. Pursuant to this Court's local rules, a copy of the proposed amended complaint should be attached as an exhibit to the motion seeking leave to file. Finally, the Court REMINDS Ogden that permission to use the Court's electronic case filing system is a privilege, not a right. (See Doc. 18).
