MINUTE ORDER: Upon consideration of Plaintiff's motion for a pre-motion conference, Dkt. 26 , it is hereby ORDERED that the motion is DENIED. As the Court previously explained, see Min. Order (Dec. 23, 2025), the Court will not entertain any motion for summary judgment in this case until Defendants have been served and given an opportunity to answer Plaintiff's complaint. Accordingly, the Court will need to resolve the pending motions to dismiss and determine whether Plaintiff has stated a viable claim for relief before considering next steps in this litigation. Beyond prematurely attempting to proceed to summary judgment, Plaintiff also seeks leave to file an amended complaint to add UniteHere as a defendant. That request is procedurally improper because Plaintiff did not include a proposed and redlined amended complaint as required by the Court's standing order, see Dkt. 2 at 3. Moreover, the request is moot because Plaintiff has since filed an updated motion to file a third amended complaint, Dkt. 44 , which supersedes the prior request. Signed by Judge Randolph D.
