MINUTE ORDER IN CHAMBERS by Judge Mark C. Scarsi: ORDER REOPENING CASE AND SETTING DEADLINE FOR FURTHER PROCEEDINGS (ECF No. 19). The Court stayed this action until the U.S. International Trade Commission rendered a final determination in Investigation No. 337-TA-1422. (Order Re: Mot. to Stay 2, ECF No. 19.) The parties report that an administrative law judge granted the private parties' motion to terminate the investigation, and that the Patent Trialand Appeal Board issued final written decisions in inter partes review proceedings in which the Board determined all challenged claims of the patents in suit were unpatentable. (March Status Report, ECF No. 27; July Status Report, ECF No. 28.) The Court lifts the stay and directs the Clerk to restore the case to the Court's active docket. The Court orders the parties to meet and confer and file within 14 days one or more of the following: (1) a motion for judgment on the pleadings or for summary judgment given the Board's final written decision; (2) a motion to stay the case pending Plaintiff's anticipated appeal of the decision; (3) a notice of settlement; (4) a stipulation of dismissal; and (5) a status report proposing a schedule for further proceedings.
