Order on Motion to Seal Document
EO: On August 26, 2026, the government filed a 92 Motion to Seal and File Ex Parte United States' Status Update Regarding Criminal Investigation ("Motion"). In the Motion, the government asserts that the information it will submit in the status update "is highly confidential as it relates to an ongoing investigation(s)." ECF No. 92 at 2. On August 31, 2026, the Court directed the government to file a supplemental brief addressing the "'compelling reasons' standard or explaining why less restrictive alternatives, such as redactions, are not feasible." ECF No. 93.
On September 14, 2026, the government filed a 96 redacted version of the subject status update. That same day, the government filed a 97 Supplement to the Motion ("Supplement") and a 98 Sealed Ex Parte Sealed Supplement to the Motion ("Sealed Supplement").
The Court has carefully reviewed the Motion, Supplement, and Sealed Supplement. The Court has also reviewed in camera the proposed sealed status update. Based on its review, the Court finds that the government has sufficiently demonstrated compelling interests in keeping the redacted information in the status update sealed from public disclosure. Civil Beat Law Ctr. for the Pub. Interest, Inc. v. Maile, 117 F.4th 1200, 1207-08 (9th Cir. 2024); Forbes Media LLC v. United States, 61 F.4th 1072, 1078-79 (9th Cir. 2023).
