For the reasons explained above, Plaintiff's motion for summary judgment on Count s II through VII of the Complaint is GRANTED IN PART and DENIED IN PART. Specifically, Plaintiff is entitled to summary judgment on Counts II, IV, and VI. But Plaintiff is not entitled to summary judgment on Counts III, V, and VII, which must proc eed to trial. On or before August 17, 2026, the parties shall file a joint status update to inform the Court of next steps in the litigation.
