Status Report Order
PAPERLESS ORDER. THIS CAUSE came before the Court upon the United States Court of Appeals for the Eleventh Circuit's vacatur and remand to this Court for further proceedings. See (ECF No. 104). This case was reassigned to the undersigned following the retirement of the Honorable Robert N. Scola Jr. Upon review of the record, it is ORDERED AND ADJUDGED that, on or before September 30, 2026, the Parties shall file a Joint Status Report addressing the following: (1) Whether the Parties agree that the Third Amended Complaint (ECF No. 66-1) is the operative pleading in this action; (2) if the Parties agree that the Third Amended Complaint is the operative pleading, the Parties shall state their respective calculations as to the time remaining for, or deadline applicable to, any response to the Third Amended Complaint; and (3) any other matters of which the Court should be made aware in connection with reopening and proceeding with this action following remand. The Parties are further ORDERED to file a Joint Scheduling Report on or before October 9, 2026. The Joint Scheduling Report shall comply with the requirements of the Federal Rules of Civil Procedure and the Local Rules of Court. Failure to file a joint scheduling report within the deadline set forth above may result in dismissal, default, and the imposition of other sanctions including attorney's fees and costs.
