Findings and Recommendations
FINDINGS, CONCLUSIONS, AND RECOMMENDATION OF THE UNITED STATES MAGISTRATE JUDGE REGARDING SOUTHEAST DIRECTIONAL DRILLING, LLC'S 44 MOTION FOR CIVIL CONTEMPT AND SANCTIONS: The Court RECOMMENDS that, pursuant to 28 U.S.C. § 636(e)(6), the District Judge order US Trinity and Haltom to appear on a date certain to show cause why they should not be adjudged in civil contempt by reason of the foregoing certified facts and analysis set forth above. The Court further RECOMMENDS that, after such hearing, the District Judge GRANT Southeast Directional's Motion for Civil Contempt [doc 44 ] and ORDER US Trinity and Haltom, pursuant to Rule 37(b)(2)(A), to pay $59,838.72 in attorneys' fees and $1,613.80 in expenses to Southeast Directional. The Court further RECOMMENDS that the District Judge grant Southeast Directional's pending Motion to Compel Post-Judgment Deposition of Haltom [doc. 36 ]. If Haltom fails to appear for his deposition or otherwise comply with the deposition notice, the Court further RECOMMENDS that the District Judge find Haltom in contempt, issue a warrant for his arrest, and order him incarcerated until he purges himself of his contempt.
