MINUTE ORDER: The Court has reviewed the Joint Status Report at ECF 88 ("JSR") and ORDERS: (1) Defendant shall produce the comparator information referenced in the JSR no later than October 7, 2026. Additionally, metadata requested for previously produced documents shall be produced on the same day; (2) Plaintiff shall produce the medical records and mitigation-related records no later than October 7, 2026; (3) to the extent either party believes discovery deficiencies remain, the parties shall meet and confer with respect to the same and file a Joint Discovery Dispute Report ("JDDR"), no later than October 23, 2026. The JDDR shall span no more than 4 pages total and shall describe the perceived deficiencies. The JDDR shall state, with specificity, the court order each party believes is necessary to cure the perceived discovery deficiencies; (4) Plaintiff's deposition shall occur in-person at a mutually agreeable location. If the parties cannot agree on a location, it shall take place in Colorado Springs, Colorado.
The Court also enters the following deadlines: (1) Discovery shall close February 16, 2027; (2) the last day to serve written discovery shall be December 16, 2026; (3) the parties shall designate all expert witnesses and serve all required disclosures related to the same, no later than November 30, 2026; (4) rebuttal experts shall be designated no later than December 16, 2026; (5) The dispositive motion deadline is March 1, 2027; (6) Plaintiff shall serve his Rule 30(b)(6) deposition topics no later than October 7, 2026; (7) Plaintiff shall file his motion for leave to amend the Complaint no later than September 28, 2026, Defendant shall respond no later than October 14, 2026, Plaintiff shall reply no later than October 23, 2026. Plaintiff's motion to amend shall be no more than 7 pages, not including the proposed complaint, redline, or any exhibits. Defendant's response shall be limited to 7 pages, not including exhibits. Plaintiff's reply shall be limited to 3 pages. A Hearing is set for October 27, 2026, at 12:00 PM (noon) before Magistrate Judge Maritza Dominguez Braswell. The Hearing will be conducted by video using the attached instructions.
