Order on Motion to Alter Judgment Order on Motion to Vacate
ORDER: This matter is before the Court on 167 Defendants' Motion To Alter Or Amend The Judgment, Renewed Motion For Judgment As A Matter Of Law, And/Or Motion For New Trial filed March 28, 2025 and the parties' 170 Joint Motion To Vacate Judgment And Stipulation Of Dismissal With Prejudice filed April 10, 2025. The parties have reached a settlement in this matter, and pursuant to Federal Rule of Civil Procedure 41(a)(1)(A)(ii), have stipulated to the dismissal of plaintiff's claims. See 170 Joint Motion To Vacate Judgment And Stipulation Of Dismissal With Prejudice, Paragraph 7. A stipulation of dismissal filed under Rule 41(a)(1)(A)(ii) is self-executing and immediately strips the Court of jurisdiction over the merits. De Leon v. Marcos, 659 F.3d 1276, 1283 (10th Cir. 2011). The parties' motions are therefore moot. Signed by District Judge Kathryn H. Vratil on 6/10/2025. (This is a TEXT ENTRY ONLY. There is no.pdf document associated with this entry.) (jsh)
