Order on Motion for Extension of Time to Complete Discovery
ENDORSED ORDER denying the joint motion to extend the discovery and dispositive motions deadlines. (Doc. # 47). As explained in the Case Management and Scheduling Order, "Motions for an extension of other deadlines established in this order, including motions for an extension of the discovery period, are disfavored. The deadline will not be extended absent a showing of good cause. Fed. R. Civ. P. 16(b); Local Rule 3.08(a). Failure to complete discovery within the time established by this Order shall not constitute cause for continuance." (Doc. # 39 at 5). Here, the parties have not established good cause to extend the discovery and dispositive motions deadlines. The parties chose to schedule the mediation conference for two days after the discovery deadline. (Doc. ## 45, 46). Thus, their displeasure now at having discovery end before their own selected mediation date is unpersuasive. Discovery began approximately four months ago and the parties have not even claimed that they had insufficient time to conduct discovery. Instead, they merely state that they wish to avoid "incurring the time and expense of discovery" prior to mediation. This does not justify an extension of any deadline. Signed by Judge Virginia M.
