ORDER adopting 40 Report and Recommendation. The Court GRANTS Plaintiff's motion to amend, (Doc. 20 ), but DENIES WITHOUT PREJUDICE its request to join CMA as a defendant. Further, the Court DENIES AS MOOT Defendant's motion to dismiss the initial complaint, (Doc. 6 ). Finally, the Court construes Defendant's motion to dismiss Plaintiff's first amended complaint, (Doc. 12 ), as a motion to dismiss Plaintiff's second amended complaint, and so construed, DENIES the motion.
