OPINION AND ORDER DENYING 317 MOTION requesting Order for Additional Findings Pursuant to Rule 52(b) filed by United Surety And Indemnity Company, DENYING 324 MOTION for Bond filed by Walsh Construction Company Puerto Rico, DENYING WITHOUT PREJUDICE 311 MOTION for Attorney Fees filed by Walsh Construction Company Puerto Rico. WCC is to promptly notify the Clerk of the First Circuit of this indicative ruling, as required by Federal Rule of Civil Procedure 62.1(c) and Federal Rule of Appellate Procedure 12.1. In the meantime, WCC is ORDERED to submit to the Court by October 7, 2026, those fees and costs incurred in the prosecution of this litigation that could be recouped under the prevailing party provision in paragraph 7 of the Bond so that USIC can respond to that request and the Court can evaluate the propriety of those fees under Rule 54 of the Federal Rules of Civil Procedure.
