MINUTE entry before the Honorable LaShonda A. Hunt: The Court has reviewed the parties' joint status report 204 and the joint status report on settlement by Plaintiffs and defendant Weichert 205 . The parties who are not pursuing settlement with each other in this case proposed competing discovery plans and briefing schedules for class certification, summary judgment, Daubert, and motions in limine 204 . On 4/30/26, the Court denied requests to stay these proceedings 202 . However, on 5/26/26, Judge Jenkins granted preliminary approval of the Tuccori settlement that defendants Compass, eXp, and United have opted into. See Case no. 1:24-CV-00150 (N.D. Ill.), Dkt. 177. Because that order temporarily enjoins litigation against any opt-in settler, this proceeding against those defendants must now be stayed. Furthermore, at Plaintiffs' request, the Seventh Circuit consolidated the pending appeals challenging the Tuccori opt-in procedure and briefing should conclude in less than 3 months. Accordingly, like with Batton I, it is now prudent to await binding guidance as to which defendants here are subject to the Tuccori settlement. While the Court does not wish to delay this three-year old case further, given these recent developments, a stay is the most efficient course of action. To be clear, this stay does not prohibit Plaintiffs from continuing their settlement efforts with Weichert or any other defendant not subject to the Tuccori preliminary approval order. Accordingly, Batton II is stayed pending further court order. By 8/26/26, the parties must file a joint status report addressing final approval of the Tuccori settlement, the pending appeals, the Weichert settlement, and any other pertinent issues for court consideration.
