ELECTRONIC ORDER: The Dallas Courthouse has a preference of handling damages for a default judgment on the paper. Weigel's damage evidence for the breach of contract claim is good; Weigel's damages evidence for the fraud claims is entirely lacking. The Court ORDERS that Weigel has one more attempt to prove up damages with mathematical precision on its fraud claim through competent evidence. Weigel may file an amended motion for default judgment by no later than 5:00 pm on October 13, 2026. If Weigel cannot get competent evidence to prove its fraud damages, it can either amend its default judgment motion to drop the fraud claims, or the Court can award Weigel $0 for its fraud claims.
