ORDER TO SHOW CAUSE: On September 9, 2026, Plaintiff filed 27 an Emergency Motion for a Preliminary Injunction and Emergency Administrative Housing Transfer ("Emergency Motion"). On or before Monday, September 14, 2026, Defendants shall show cause, in writing, as to why Plaintiff's Emergency Motion should not be granted. Plaintiff may, but is not required to, file a reply on or before Wednesday, September 16, 2026, at 10:00 AM. Plaintiff is advised that, for free, confidential, limited-scope legal assistance, he may wish to contact the City Bar Justice Center's Federal Pro Se Legal Assistance Project in Brooklyn by calling (212) 382-4729 or online at https://www.citybarjusticecenter.org/projects/federal-pro-se-legal-assistance-project. The Federal Pro Se Legal Assistance Project is not a part of, or affiliated with, the Court. ORDER: The Court is in receipt of Plaintiff's Amended Complaint 26 . In light of the information therein, the Court's oral ruling at the September 10, 2026, Order to Show Cause hearing denying Plaintiff's Motion for an Extension of Time to file an Amended Complaint 20 is hereby vacated. Plaintiff's Amended Complaint 26 is accepted for filing and shall be the operative complaint. Defendants are directed to answer or otherwise respond to the Amended Complaint by October 13, 2026. To the extent that Defendants seek to move to dismiss the Amended Complaint 26 , the Court sets the following briefing schedule: Defendants shall serve moving papers and file cover letters confirming service on the docket by October 13, 2026; Plaintiff shall serve opposition papers by November 12, 2026; and Defendants shall serve a reply, if any, and file the fully briefed motion by November 19, 2026. As a courtesy to the Court, the parties shall refrain from filing motion papers until the motion has been fully briefed. See Individual Practice Rules § III.G.
