Accordingly, pursuant to Local Rule 3.09, this case is DISMISSED without prejudice as to Defendant Xactus LLC and subject to the right of Plaintiff and Defendant Xactus LLC, within sixty days of the date of this order, to move for entry of a stipulated form of final order or judgment as to Defendant Xactus LLC should these parties so choose or for any party in this action to move to reopen the action as to Defendant Xactus LLC, upon good cause shown. However, after the sixty-day period, the dismissal as to Defendant Xactus LLC shall be with prejudice. The Clerk is DIRECTED to terminate Defendant Xactus LLC as a party to this case.
