TEXT ORDER. On August 13, 2026, attorneys David Rothenberg and Michael Rothenberg filed documents purporting to substitute themselves as counsel of record for defendant Remo Pasquarella ("Pasquarella") in place of prior counsel Daniel J. Moore and Daniel J. Palermo of Harris Beach Murtha Cullina PLLC ("Harris Beach"). (Dkt. 43; Dkt. 44). The Clerk of Court's Office subsequently issued an E-Filing Notification advising that the filed documents did not comply with the requirements of Local Rule of Civil Procedure 83.2, and that they were required to be re-filed in compliance therewith. However, no corrective action was ever taken, and thus Mr. Moore and Mr. Palermo remain counsel of record for Pasquarella. Despite this, in a letter filed on September 9, 2026, Mr. Palermo omitted Pasquarella from a list of defendants represented by Harris Beach in this case. (See Dkt. 45 at 1). Based on this recent procedural history, it is unclear whether the docket accurately reflects Pasquarella's current representation. By no later than October 23, 2026, counsel for Pasquarella must clarify his current representation by following the appropriate procedure for substitution of counsel under Local Rule 83.2. If Harris Beach intends to remain as counsel of record for Pasquarella, they must file a letter advising the Court of the same by no later than October 23, 2026. SO ORDERED. Signed by Hon. Colleen D.
