MOTION to Dismiss Pursuant to Federal Rule 12(B)(2), Joinder in Thryv's Motion Transfer, and Motion to Dismiss Pursuant to12(B)(6). filed by Daniel Sorty, 42 MOTION to Strike Document No. 24 Declaration of Plaintiff and Lawrence D. Lissauer. filed by Daniel Sorty. For the foregoing reasons, Defendants Thryv's and Storey's Motions to Strike and Motions to Transfer are DENIED. Defendants' Motions in the Alternative to Disregard a re GRANTED IN PART. Defendant Storey's Motion to Dismiss for Lack of Personal Jurisdiction is GRANTED. Defendants' Motions to Dismiss for Failure to State a Claim are DENIED IN PART with regards to Plaintiff's defamation claims, but GRANTED IN PART with regard to Plaintiff's NIED and IIED claims. Accordingly, the Court dismisses Defendant Storey without prejudice and Plaintiff's NIED and IIED claims with prejudice. The Court will separately issue a notice of initial pretrial conference.
