Chinese Gov't To Argue Before High Court In Vitamin C Case

Law360 (April 13, 2018, 8:24 PM EDT) -- In another U.S. Supreme Court first, the government of China will participate in oral arguments as an amicus trying to uphold a Second Circuit decision that nixed a $147.8 million price-fixing judgment against Chinese vitamin C exporters, the high court said Friday.

The Chinese Ministry of Commerce already broke ground when it filed an amicus brief last week backing the appellate decision, which found a New York district court failed to properly consider international comity since U.S. antitrust law conflicted with Chinese government mandates.
