Humana Beats NJ Specialty Pharmacy's Antitrust Suit

Law360, New York (August 9, 2017, 5:08 PM EDT) -- A New Jersey federal court on Wednesday tossed allegations that Humana Inc. wrongfully engaged in monopolistic conduct by steering patients to its own specialty pharmacy, thereby harming rival specialty pharmacy Prime Aid Pharmacy Corp.

U.S. District Judge Susan D. Wigenton said Prime Aid’s alleged market of patients affected by Humana’s conduct is too narrow, noting that the pharmacy hasn’t demonstrated that specialty pharmacy services are an aftermarket of the primary market for insurance plans.
