Developments In State Data Breach Notification Laws

In the past year, the last three remaining states — Alabama, New Mexico and South Dakota — have enacted data breach notification statutes so that all 50 states now require notification to their residents in the event a breach involving the personal information of those residents. In addition, several states — Arizona, Colorado, Delaware, Louisiana and Oregon — amended their existing data breach notification statutes the past year in response to the evolving landscape. Certain trends are evident in the newly enacted and amended data breach notification statutes. These trends are indicative of broader societal attitudes toward data breaches....
