DOL Revises H-2B Wage Methodology After Legal Challenge

Law360, New York (April 23, 2013, 5:26 PM EDT) -- The U.S. Department of Labor released a rule Monday revising how it calculates prevailing wages for the H-2B temporary foreign worker program, in response to a March court decision that vacated part of a 2008 DOL wage rule that allegedly depressed pay for U.S. workers.

The DOL and the U.S. Department of Homeland Security are jointly issuing the interim final rule and request for comments, which was published online on Monday and is slated for publication in the Federal Register's print edition on Wednesday.
