NLRB Thumbing Nose At Noel Canning, DC Circ. Told

Law360, New York (June 17, 2013, 4:02 PM EDT) -- Santa Fe Tortilla Co., Encino Hospital Medical Center and a former union member on Friday urged the D.C. Circuit to put the brakes on the National Labor Relations Board, arguing that it is "thumbing its nose" at the appeals court's Jan. 25 recess appointment ruling.

SFTC, Encino and Jeanette Geary, all of which are embroiled in litigation with the NLRB, asked the D.C. Circuit to block the NLRB from adjudicating or deciding its cases until it has a valid quorum, which, they said in a joint brief Friday, it has lacked since Aug. 27, 2011.
