Court Of Fed. Claims Can Hear FLSA Dispute Against US

Law360, Los Angeles (October 18, 2013, 4:09 PM EDT) -- The U.S. Court of Federal Claims ruled Friday that it has jurisdiction to review an Indian Health Services employee's Fair Labor Standards Act claim, saying the statute expressly authorizes it to hear the claim.

Judge Susan G. Braden denied the government's consent motion to transfer Larry D. Tallacus' case to Oregon federal court, rejecting the argument that the Court of Federal Claims doesn't have subject matter jurisdiction over Tallacus' FLSA claim because the statute establishes a comprehensive remedial process outside the court.
