EPA Lets ND Manage Own Carbon Sequestration Program

Law360 (April 10, 2018, 9:46 PM EDT) -- The U.S. Environmental Protection Agency on Tuesday made North Dakota the first state in the nation with the power to implement and enforce its own carbon sequestration well control program everywhere in the state except on Native American lands.

Many states have permission from the EPA to use their own programs for oil and gas injection wells and industrial and municipal waste disposal wells, among other well types. But North Dakota is now the first to get control over a carbon storage, or Class VI, well program.
