EPA Biofuel Rulings Are Bulletproof, Small Refiners Say
Law360 (March 12, 2019, 3:06 PM EDT) -- Refiners granted small-refinery exemptions from the Renewable Fuel Standard by the U.S. Environmental Protection Agency told the D.C. Circuit that a coalition of ethanol and biofuel producers has no legal basis to challenge the agency's decisions, much less mount a broader attack on the RFS program itself.
Wyoming-based refining units of HollyFrontier Corp. and Sinclair Oil Corp., which received the exemptions from the EPA in 2017 and 2018, said that Producers of Renewables United for Integrity Truth and Transparency relies solely on speculation that the EPA's actions have affected the RFS market to challenge the decisions and doesn't provide any evidence...
