Pa. Enviro Group Scores Win In Fight Over LNG Facility Info

Law360 (August 9, 2019, 4:09 PM EDT) -- The Federal Energy Regulatory Commission has been sent back to search its files after in-house attorneys agreed that the agency failed to properly respond to an environmental group's request for documents about approvals for a controversial Philadelphia-area export facility for liquefied natural gas.

The Office of General Counsel at FERC said on Thursday that the agency had improperly pointed the Delaware Riverkeeper Network, which had sought information about the New Fortress Energy facility under a Freedom of Information Act request, to publicly available documents on its website without conducting an internal search of nonpublic files.
