3rd Circ. Won't Rehear Activists' Bid To Join Fracking Fight

Law360, New York (August 23, 2016, 2:21 PM EDT) -- The Third Circuit refused Monday to reconsider its decision to affirm a lower court and not let two activist groups intervene in a Pennsylvania town’s defense of a now-defunct ordinance that barred the disposal of fracking wastewater.

A Pennsylvania federal court had barred Little Mahoning Watershed and the East Run Hellbenders Society Inc. from intervening in a suit against Grant Township by Pennsylvania General Energy Co. LLC, which has successfully gotten the wastewater ordinance tossed. The trial court determined in October that the town was not authorized to regulate underground injection wells, among other things.
