Future Of Calif. Cap-And-Trade Is Up To CARB

Law360, New York (August 9, 2017, 5:18 PM EDT) -- On July 17, 2017, the California legislature passed Assembly Bill 398 into law, extending the state’s signature climate change policy — the cap-and-trade program — through 2030. Prior legislation only provided explicit authorization for the program through 2020 and there was significant uncertainty as to whether the California Air Resources Board had authority to continue regulating greenhouse gas emissions beyond 2020.
