Pa. High Court Strikes Down Pro-Fracking Zoning Law

Law360, Philadelphia (December 19, 2013, 3:38 PM EST) -- The Pennsylvania Supreme Court on Thursday struck down a controversial law preventing local governments from passing zoning ordinances prohibiting natural gas drilling, concluding the law violated the state’s constitution.

In a 4-2 decision, the justices affirmed the core of a 2012 ruling by the state’s Commonwealth Court, which halted the implementation of parts of the statute, known as Act 13.
