Before the Court is the parties' Joint Motion for Determination of Discovery Dispute [Doc. No. 82], which seeks the Court's assistance in resolving whether a minor plaintiff should be required to identify all social media accounts used since 1/1/2018 in response to defendant's Interrog. No. 13 and/or Doc. Req. No. 14. Defendant seeks this information to investigate whether the minor plaintiff publicly disclosed information claimed in the Complaint to be private and/or confidential. Defendant believes any such disclosure may be relevant to its defense. Given the sensitive nature of information that could be found on a minor plaintiff's social media accounts, including the identities and private information of other minors who are not parties to the action, the Court finds that a confidentiality protective order would not be enough to protect the privacy interests at issue. Therefore, defendant's request for an order compelling the minor plaintiff to identify each social media account used since 1/18/2018 is DENIED. However, in response to a narrowly tailored interrogatory and/or document request, the minor plaintiff must disclose whether and to what extent he/she publicly revealed any medical information on social media since 1/18/2018 that is claimed in the Complaint to be private or confidential. Any such narrowly tailored interrogatory or document request must be served on the minor plaintiff no later than seven (7) days after this Order is entered. Signed by Magistrate Judge Karen S.
