Section 41(a)(l)(A)(ii) by and between the undersigned as the attorneys of record for all the parties to the above-entitled actions, whereas no party hereto is an infant or incompetent person for whom a committee has been appointed and no person not a party has an interest in the subject matter of the action, that this action against Defendant VILLAGE OF CHESTER, and VILLAGE OF CHESTER BOARD OF TRUSTEES in the above-entitled action be, and the same hereby are discontinued with prejudice, and without costs for fees awarded to either party. This stipulation may be filed without further notice with the Clerk of the Court. The Clerk of Court is directed to terminate this action. SO ORDERED.
