ORDER TO SHOW CAUSE: The parties have missed three status report deadlines in this case, on April 15, April 21, and May 7, 2026. The Court's most recent order, dated April 24, 2026, directed each party to file a status report by May 7, 2026, and warned that "[f]ailure to so may result in sanctions, up to and including dismissal of this action." Another two months have passed with no response. In its discretion, the Court now gives plaintiff a last opportunity to prosecute this action. Plaintiff is directed to show cause, by July 17, 2026, why this action should not be dismissed for failure to prosecute, pursuant to Fed. R. Civ. P. 41(b). Ordered by Magistrate Judge Clay H. MINUTE ENTRY for Telephone Conference proceeding held before MJ Eichenholtz on 6/29/2026. Appearance for Plaintiff: Dibo Hafif, pro se. Appearance for Defendants: Mark Ian Binsky \ Mamoon Saleemi. Status conference held. For the reasons discussed on the record, counsel for the City defendants is directed to provide service address for Defendants Hufford, Oy, Ivankovsiy, Ramroop, Yu, Posokohv, Boyce, Parisi, Taylor, and Uruymagov to Plaintiff on or before 7/3/2026. As a reminder, Plaintiff must serve these defendants on or before 8/18/2026.
For the reasons stated on the record, Plaintiff's motions 138 and 140 to grant in forma pauperis status for the purpose of having the USMS serve these defendants is DENIED. As Plaintiff has already paid his filing fee, this ruling is limited only to his request that the USMS serve the remaining City Defendants. See 28 U.S.C. § 1915(a)(1) (authorizing litigants to proceed IFP when "unable to pay" filing fees).
Plaintiff also indicated that he intends to name another NYPD defendant because he learned of this person's existence in recent body camera footage. Plaintiff was advised he must move to amend the complaint to add this individual. Plaintiff must do so by 7/10/2026.
Defendant Mansour and Wahbas's motion to compel 127 is GRANTED. For the reasons stated on the record, Plaintiff is deemed to waive any objections not already interposed to these Defendants' requests and provide all remaining responsive information and documents by 7/17/2026.
The parties shall submit a status letter on or before 7/29/2026 updating the Court on any remaining issues pertaining to service, discovery or other matters. (FTR: 4:01 - 4:40) (DC)
