MINUTE entry before the Honorable Jeffrey Cole: Video status conference held. In response to the Court's inquiry, counsel indicated that there may be some interest in further private mediation, depending upon the willingness of one of the parties to agree with a term of the settlement proposed by the other. Counsel and the parties are urged to renew settlement discussions, whether in this or a private forum. They and their clients ought not forget as the late Judge Will sagely noted, the 'best' case can be lost and the 'worst' case can be won and juries [or judges] may find liability but no damages.
