Motion
MOTION by Defendant Abovo8 LLC for sanctions under Rule 11
Presented before District Judge
Minute
MINUTE entry before the Honorable Maria Valdez: Hearing held on Defendant's Motion to Compel 54 and Plaintiff's Motion to Compel 63 on 6/30/26. Defense counsel informed the Court that following a search of Plaintiff's recent production, Defendant no longer has discovery concerns related to its own defense. Accordingly, Defendant's Motion to Compel 54 is denied as moot. The issue of the identification of trade secrets remains relevant with respect to Plaintiff's Motion to Compel 63 , which is entered and continued. Unless and until Plaintiff narrows and clarifies its discovery requests, describing the trade secrets at issue with specificity, Defendant cannot be compelled to respond. As the Court admonished Plaintiff in open court, its claim that trade secrets need not be identified with particularity until summary judgment is unsupported and wholly rejected. Written discovery is at an end, and Plaintiff must fully articulate its allegations at this stage. The parties shall engage in a face-to-face meet and confer on the definition of trade secrets and shall file a status report on their efforts no later than 7/13/26. Mailed notice.
