Order on Motion for Extension of Time
ELECTRONIC ORDER:
Before the Court is the parties' Joint Motion for Leave to Extend Mediation Deadline (the "Joint Motion") (Doc. No. 36). The Court starts by noting that Federal Rule of Civil Procedure 16(b)(4) is the proper standard for requesting modification of a scheduling order, not Federal Rule of Civil Procedure 6(b) as the parties assert. See Fed. R. Civ. P. 16(b)(4) ("[a] schedule may be modified only for good cause and with the judge's consent"). However, THIS ONE TIME, the Court can and does find good cause for the requested extension of the mediation deadline set forth in its Scheduling Order (Doc. No. 16). See id. Accordingly, the Court GRANTS the Motion. The parties shall complete mediation by August 19, 2026 and shall file their joint mediation report by August 26, 2026. This deadline will not be extended again absent good cause and exigent circumstances.
As of the date of this Order, if any party moves for extension of time or deadline, or for modification of the Court's Scheduling Order, without citing to the applicable standard, the Court will summarily deny the motion.
