Order on Motion for Default Judgment
MEMORANDUM & ORDER. For the reasons stated in the attached Memorandum & Order, the Court grants in part and denies in part 48 Plaintiffs' motion for default judgment and damages. The Court (1) grants Plaintiffs' motion for unpaid overtime and spread of hours pay; and (2) denies Plaintiffs' motion for minimum wage and Wage Theft Protection Act violations. The Court awards Plaintiffs actual and liquidated damages of $160,182.50 equal to the amount Plaintiffs requested for their unpaid wage and spread of hours claims. Prejudgment interest shall be calculated at the rate of 9 percent per annum. If any amount of the judgment remains unpaid within ninety days after judgment or after the time to appeal has expired if no appeal is pending, Plaintiffs damages under the NYLL will be increased by fifteen percent in accordance with NYLL §198(4).
