MINUTE entry before the Honorable Steven C. Seeger: Plaintiff's motion to set a briefing schedule for dispositive motions (Dckt. No. 122 ) is hereby granted in part. This Court has given the parties a series of extensions, until they ran out of extensions, and this Court declared fact discovery over. (Dckt. No. 115 ) This Court set a dispositive motion deadline of May 31, 2024. (Dckt. No. 116 ) The parties later declared that they agreed that they needed 45 more days, without asking this Court for permission for an extension. (Dckt. No. 121 ) So this Court gave them two more weeks. Now, Plaintiff asks for a briefing schedule. Plaintiff believes that Plaintiff should have 66 days to respond to the motion for summary judgment, because Defendant supposedly had 66 days to prepare the motion. That's the wrong way to think about the issue. Dispositive motions are traditionally due shortly after the close of discovery. This Court will use the same schedule that it uses in other cases. Responses to summary judgment briefs are due 28 days after the motion, and replies are due two weeks later. So, here's the schedule. The response to any motion for summary judgment is due by July 12, 2024, and the reply is due by July 26, 2024.
