Status Conference
Minutes of proceedings [non-document] before Judge J. Philip Calabrese. A status conference was held on the record on September 17, 2026 by Zoom. Benjamin P. Pfouts and Patrick J. Perotti appeared on behalf of the Plaintiffs. Wesley E. Stockard, Rachel P. Kaercher, and Simon J. Torres appeared for Defendants Swagelok Company, UnitedHealth Group, Inc., United Healthcare Services, Inc., UnitedHealthcare Insurance Company, and Optum Inc. Daran P. Kiefer appeared on behalf of Defendant Kreiner & Peters, Co. Counsel provided an update on the Magistrate Judge's in camera review. The Court raised issues and questions regarding Plaintiffs' proposed second amended complaint (Laura Patterson ECF No. 113 ; Eric Patterson ECF No. 132) and Defendants' motion to certify an interlocutory appeal pursuant to 28 U.S.C. § 1292(b) (Laura Patterson ECF No. 116 ; Eric Patterson ECF No. 136). Counsel answered the Court's non-substantive questions and provided their respective views on the issues. For reasons stated on the record, the Court granted Defendants' unopposed motion for extension of time until October 2 to respond to Plaintiffs' motion to amend complaint. (Laura Patterson ECF No. 115 ; Eric Patterson ECF No. 135.) The Court set a briefing schedule on the motion to certify an interlocutory appeal: Plaintiffs shall respond by September 24, 2026; any reply due by September 30, 2026. The Court will decide Plaintiffs' motion for leave to file a second amended complaint and Defendants' 1292(b) motion once fully briefed then set a status conference. Judge J.
