Order on Motion for Extension of Time to Complete Discovery
ORDER denying 114 Letter Motion for Extension of Time to Complete Discovery. The Court is in receipt of (1) two letters from Defendants Defalco Construction and Michael C. Falco (collectively, "DeFalco Defendants") at Dkt. Nos. 112113 and (2) Plaintiffs' letter request to extend fact discovery. On June 9, DeFalco Defendants filed a letter asserting that Plaintiffs failed to respond to DeFalco Defendants' April 7 First Request for the Production of Documents. Dkt. No. 113. DeFalco Defendants represent that these RFPs, which seek "records of Plaintiffs' employment, hours, and pay," are central to Plaintiffs' FLSA and New York Labor Law claims. Id. DeFalco Defendants assert Plaintiffs emailed the following response (and only after DeFalco Defendants followed up): "[W]e don't make any objections to your requests, and we don't have any more documents to produce than we have already produced." Id. On June 22, DeFalco Defendants filed an additional letter updating the Court that to date, Plaintiffs have failed to provide timely discovery responses or any document productions to DeFalco Defendants. Dkt. No. 113. Plaintiffs never filed a response to DeFalco Defendants' two letters. Instead, on June 22, Plaintiffs filed a letter motion to extend certain discovery deadlines. The Court is concerned regarding Plaintiffs' complete failure to respond to DeFalco Defendants' letters, particularly because DeFalco Defendants have essentially asserted that Plaintiffs have failed in complying with its discovery obligations. To that end, Plaintiffs are ordered to file a letter with their response to DeFalco Defendants' letters at Dkt. Nos. 112 and 113 by July 7, 2026 at 12 P.M. In the meantime, Plaintiff's request to extension certain discovery deadlines at Dkt. No. 114 is DENIED with leave to refile once the assertions raised in Defendants' two letters are resolved.
