Text Only Order
** TEXT ONLY ORDER ** Plaintiff's counsel has filed a petition for attorney fees under 42 U.S.C. § 406(b), which is cosigned by Attorney Dana Duncan and Attorney Vince Angermeier. (Dkt. # 62 ). However, as defendant points out in his response (dkt. # 64 ), the accompanying brief is signed by, and requests fees for, only Attorney Duncan, even though the brief refers to hours apparently spent by both attorneys in litigating plaintiff's appeals in this court and the Eastern District of Wisconsin. (Dkt. # 63 , at 3 and 14.) In addition, the time records submitted in support of the motion show that Attorney Angerneier worked a total of 102 hours, Attorney Duncan worked a total of 94.10 hours, and a paralegal worked 6.9 hours, totaling 203 hours. (Dkt. ## 62 -4 and 62 -5.) However, the brief states without further explanation that the fee award accounts for a total of 169.10 hours in attorney time at "an effective rate of $348.56 per hour," as well as 6.9 hours of paralegal time "paid as staff compensation." (Dkt. # 62 , at 3.) Accordingly, plaintiff's counsel has until August 10, 2026, to clarify for the court the specific number of hours that each attorney and paralegal expended on plaintiff's appeals, their requested hourly rate for such hours, and why the net fee award should be paid only to Attorney Duncan. Signed by District Judge William M. Conley on 7/29/2026. (nln) Modified on 7/29/2026 (nln).
