MINUTE ORDER: Proposed Plaintiff-Intervenor Washington Suburban Sanitary Commission has filed an unopposed Motion to Intervene as Plaintiff. Dkt. 37 . The Commission relies on Institutional Shareholder Services, Inc. v. SEC, 142 F.4th 757 (D.C. Cir. 2025), to argue that "intervenors that seek the same relief sought by at least one existing party need not" demonstrate Article III standing. Dkt. 37 -1 at 18 (quoting Inst. S'holder Servs., Inc., 142 F.4th at 764 n.3). But that case identified an outstanding line of circuit "precedent requiring an intervenor to demonstrate Article III standing even if pursuing the same relief as an existing party" and declined to resolve the "tension" on the issue. Inst. S'holder Servs., Inc., 142 F.4th at 764 n.3 (collecting cases).
