MINUTE entry before the Honorable Keri L. Holleb Hotaling: Telephonic status and motion hearing held on 9/9/2026. The Court hereby GRANTS Plaintiff's Motion to Enforce the Court's 6-11-2026 Discovery Order and for Sanctions [Dkt. 55]. By 9/22/2026, Defendant is to respond (without objection as his objections have been deemed waived at Dkt. 52) to the interrogatories and requests for production that were ordered to be produced in the 6/1/2026 Order (see Dkt. 52), without further conference between the parties. The Court denies awarding sanctions with this motion but will not hesitate to do so in the future if any discovery orders are not complied with. Plaintiff's motion for spoliation sanctions [Dkt. 67] is taken under advisement. However, as to the iCloud information sough, because Defendant has identified in his responses to Interrogatories 6-7 that he possessed a Lenovo laptop received from Plaintiff, "a personal Apple Iphone and macbook pro" and that he used those devices "for any business purpose during the Time Period," Plaintiff is granted access to Defendant's iCloud account associated with the email identified at Dkt. 73-1 and it shall be searched for relevant and responsive data during Time Period. This search shall take place before 9/22/2026 and Defendant shall work with the expert identified by Plaintiff who will either complete the search and extraction or instruct Defendant how to complete the search and extraction (with the expert watching) so that all data produced includes the accompanying metadata. The Court hereby sets a telephonic status on 10/6/2026 at 10:45 a.m. CT. The call in information is 855-244-8681, and the participant access code is 2315 0911 461#. Members of the public and media will be able to call in to listen to this hearing but will be placed on mute. Persons granted remote access to proceedings are reminded of the general prohibition against photographing, recording, and rebroadcasting of court proceedings. Violation of these prohibitions may result in sanctions, including removal of court issued media credentials, restricted entry to future hearings, denial of entry to future hearings, or any other sanctions deemed necessary by the Court. Additionally, persons are to place their devices on mute when they are not speaking. Any motions the parties wish to be heard at the status must be filed at least 7 days prior to the status date.
