FINAL JUDGMENT AND PERMANENT INJUNCTION: Based on these findings and conclusions of law, JUDGMENT is entered in favor of Patagonia against Defendants, as follows: A. Defendants are jointly and severally liable to pay Patagonia three hundred thousa nd dollars ($300,000) in statutory damages and attorneys fees. Defendants, their agents, employees, attorneys, successors, assigns, affiliates, joint ventures, related companies, and any person(s) in active concert or participation with them, a nd/or any person(s) acting for, with, by, through or under Defendants control, who receive(s) actual notice of this Judgment, are hereby permanently enjoined and restrained, anywhere in the world, directly or indirectly, from doing, authorizing or pr ocuring any persons to do any of the following: and further set forth in this Order. The parties "have asked the Court to enter a consent judgment to resolve the case," Dkt. 160, and because in a consent judgment "all of the relief to be provided by the judgment and all of the wording to effectuate that relief is agreed to by the parties," the Court "makes no determination of the merits of the controversy or of the relief to be awarded," Janus Films, Inc. v. Miller , 801 F.2d 578, 582 (2d Cir. 1986). This decree "may not be cited as an adjudication of contested issues"with respect to third parties. Id. at 584 (internal quotation marks omitted).
