Court is amenable to the filing of consolidated briefs where practicable, while also permitting individualized arguments where applicable. Parties may take however many pages they think is reasonable to file their briefs while keeping in mind the Court's view of over-length submissions.
Court instructed Lead Counsel to advise Plaintiffs counsel of the Courts view that the Plaintiffs best interests would be served by representation through Lead Counsel, particularly in light of the relevant preemption arguments that Lead Counsel has familiarity with. Court will engage in a case management conference if necessary regarding logistics, not substantive arguments, if there are any issues that need to be discussed regarding Lead Counsels ability to provide effective representation to all Plaintiffs.
Defense counsel advised the Court that they may submit proposed orders to show cause in their efforts to clear the inactive docket concerning certain Plaintiffs' counsel who have been non responsive with respect to obtaining the releases required under the settlement agreements.
