Docket Text Order: The Court DENIES Defendants' 23 Motion for Leave to File Under Seal. Having reviewed the motion, sealed memorandum in support, and sealed memorandum regarding the inability to file redactions, the Court finds that the Defendants have failed to articulate a valid basis for sealing. In their motion, Defendants contend that HIPAA "makes the protected health information of persons private and not subject to release except for certain reasons" and seek to seal to protect "the privacy of the treatment of Plaintiff." Doc. 23 6-8. But as Defendants acknowledge in a sealed memorandum, Doc. 25, "HIPAA neither applies nor supplies a basis for sealing the medical information Plaintiff put at issue in this action." Mello v. Page, No. 4:23-CV-01249-MTS, 2023 WL 8529133, at *2 (E.D. Mo. Dec. 8, 2023) (collecting cases). However, these are Plaintiff Lindsay A. Robertson's medical records, and she is the party with the most significant interest in protecting the information. As such, the Court directs Robertson to justify sealing with a supplemental memorandum, along with either proposed redactions or a specific justification as to why redactions are not possible, no later than June 3, 2026. Her failure to do so will result in Docs. 24-1 and 24-2 becoming a part of the public record without further notice. Signed by District Judge Zachary M. Bluestone on 05/29/2026. (JRZ)
