(IN CHAMBERS) ORDER TO SHOW CAUSE RE DISMISSAL FOR LACK OF PROSECUTION by Judge John W. Holcomb: Plaintiff filed a proof of service as to Defendant 10 ; however, no responsive pleading has been timely filed. An action may be dismissed for lack of prosecution pursuant to the Court's inherent authority in circumstances of unreasonable delay. See Link v. Wabash R. Co., 370 U.S. 626, 630-31 (1962); Hernandez v. City of El Monte, 138 F.3d 393, 400 (9th Cir. 1998); see also Fed. R. Civ. P. 41(b); L.R. 41-1. Accordingly, the Court, on its own, ORDERS Plaintiff to SHOW CAUSE in writing no later than July 15, 2026, why this action should not be dismissed for lack of prosecution as to Defendant. As an alternative to a written response, Plaintiff may file, on or before the above deadline, the following: (a) a request for entry of default pursuant to Fed. R. Civ. P. 55(a) or (b) a notice of voluntary dismissal pursuant to Fed. R. Civ. P. 41(a). This Order shall also discharge upon Defendant's filing of a responsive pleading on or before the above deadline. The failure to timely file an appropriate and adequate response shall result in dismissal without prejudice. IT IS SO ORDERED. THERE IS NO PDF DOCUMENT ASSOCIATED WITH THIS ENTRY.
