BRAGDON on 08/21/2026: The Court therefore GRANTS Plaintiff's Motion for Leave to Amend (D.E. 15 ) to the extent necessary to recognize that the amendment was permissible as a matter of course under Rule 15(a)(1)(B). Because that pleading supersedes the original Complaint, MetLife's Motion to Dismiss (D.E. 11 ) is DENIED WITHOUT PREJUDICE AS MOOT. The Court further GRANTS Plaintiff's Motion to Amend/Correct (D.E. 16 ) pursuant to Rule 15(a)(2). The Amended Complaint at D.E. 16 -2 shall be the operative complaint in this action. MetLife is encouraged to renew or refile its motion to dismiss as directed to the operative Amended Complaint. Plaintiff's Motion to Deem Amended Complaint as Operative Complaint and Deny as Moot Plaintiff's Motion for Leave to Amend Complaint (D.E. 20 ) is DENIED AS MOOT. (ssc)
