   MINUTE entry before the Honorable Steven C. Seeger: The Court reviewed the Joint Initial Status Report (Dckt. No. 16 ), and hereby adopts the proposed schedule. Fact discovery will close on August 20, 2021. Scheduling order to follow. The Joint Initial Status Report states that Defendant VIP has not filed an appearance, and that "[d]iscovery may be difficult to obtain from Defendant VIP Charter." But the parties do not explain why. Also, based on the docket, Defendant VIP Charter's answer was due on October 8, 2020 (Dckt. No. 13 ). But Defendant VIP Charter has not filed an answer, and Plaintiff National Liability and Fire Insurance Company has not pursued it, either. Unless Defendant VIP Charter intends to litigate this case (and act soon), Plaintiff must seek relief under Rule 55. A case cannot linger with a non-participatory defendant. The Court stayed the briefing on the motion to dismiss (Dckt. No. 15 ), but did not stay Defendant VIP Charter's obligation to respond to the complaint.
